Non Statutory Notice

A non statutory notice is quite similar in scope to the:

California PRELIMINARY NOTICE or Florida NOTICE TO OWNER

These notices are served before or shortly after you begin supplying materials, labor, equipment or services to the construction project. They are REQUIRED to establish your lien rights on California or Florida construction projects

The Non Statutory Notice is prepared and served in the exact same manner. The only difference is that the Non Statutory Notice is NOT REQUIRED to establish your lien rights and therefore, they are served without reference to any state statute.

The main objectives of the Non Statutory Notices are:

  • They inform the Real Property Owner, General Contractor, Construction Lender (if any) and all entities between you and the Property Owner that you are participating in the project and that you are aware of your lien rights.
  • They allow for complete verification of the alleged information you may have included in your contract, work order, or project agreement, at the beginning of the project. Thus providing ample time for you to make any needed adjustments.
  • They formally inform those who may approve payments that you have the expectancy of being paid within the terms of your agreement with the firm or person who contracted your company to participate in the construction project.

Verification Report

A Verification Report is also quite similar in scope to the:

California PRELIMINARY NOTICE or Florida NOTICE TO OWNER

These notices are both served shortly after you begin to supply materials, labor, equipment or services to the construction project. They are REQUIRED to establish your lien right on California or Florida construction projects

The Verification Report is also prepared in the exact same manner. The only difference is that the Verification Report is NOT SERVED and it is not required to establish your lien rights. The single objective of the Verification Report is:

  • They allow for complete verification of the alleged information you may have included in your contract, work order, or project agreement, at the beginning of the project. Thus providing ample time for you to make any needed adjustments.

Non Statutory Notice

eAlert ONLY!

The eAlert ONLY! option is by far the least costly method for protecting your opportunities to file a mechanics lien. This option is used for projects in states which have no requirement for the serving of a preliminary notice, but do require that specific action be taken before the time expires to file a mechanics lien. By requesting an eAlert ONLY! you will receive notification within 14 days prior to your potential lien rights expiring. In addition, you will be offered a link to the request form for preparing and serving the next required notice.
